Until August 30, 2025, Ukraine has a simplified procedure for returning to the service of servicemen who left unauthorized parts. The corresponding decision was made by the Verkhovna Rada, and the Ministry of Defense released the algorithm of return.
According to the Criminal Code (Article 401), the military, who for the first time committed unauthorized abandonment during martial law, can be released from liability - subject to voluntary return to the service and appeal to the investigative bodies.
How to return to the service: step by step
-
The military must contact the reserve battalion or the Military Law Enforcement Unit (VSP). It will be sent to a backup battalion in the VSP.
-
The battalion checks whether there are data on offenses in the ERDR (register of pre -trial investigations).
-
The military then applies to the investigator, the prosecutor or the court for the intention to return to the service.
-
If the commander of the military unit gives a written consent, the court may release such a military from criminal liability.
Three days - no crime
If the military returns to part 3 days after leaving, there will be no responsibility. He is restored by all proper payments and security.
What if more than three days have passed?
In this case:
-
Law enforcement officers record offenses in the ERDR;
-
The military submits a written address to the commander of the unit;
-
upon receipt of consent - appeals to court;
-
The court's decision to release from liability allows you to return to the service.
What will happen when re -violation?
In case of re -unauthorized lifting part or unwillingness to return:
-
The military can be delayed;
-
he will be selected by a preventive measure;
-
The investigation sends the case to court;
-
The prison period is from 5 to 10 years.
Can be reported through an application
Since December 2024, the VSP has accepted reports from the military and through the application of the Army+. The report automatically comes to consideration, after which the VSP organizes contact, verification of documents and referral to the battalion of the reserve.
After confirmation to the army+, the military has 24 hours to appear in the ASP governing body and go to the reserve.
