In the city of Sambir in the Lviv region, a court sentenced a local resident who refused to receive a “combat” summons and mobilize. The man explained his refusal by having vision problems and a fractured femur, but he was found fit for service.
According to the decision of the Sambir City District Court, he received three years in prison for evading mobilization, although he can still appeal.
As indicated in the case materials, the man first appeared at the CCC in April 2024, where he was sent for an additional medical examination to an ophthalmologist and a traumatologist. However, he never passed the examination. In June, he was again taken to the military enlistment office, where he was again examined by a military medical commission and found fit for service. He was handed a summons indicating the time and place of his arrival at the military unit, but he refused.
Despite the fact that the man signed a statement confirming his fitness for service, he refused to receive a summons, citing health problems. CCC employees called law enforcement officers, who recorded his refusal.
In September 2024, he underwent a re-examination at the regional military medical commission, where he provided medical records and X-rays confirming his previous fracture of the femoral neck. However, he was again declared fit for service. The man did not challenge the conclusions of the military medical commission and received a warning about responsibility for evading mobilization.
The court found that his guilt was fully proven by the materials of the pre-trial investigation. Considering that he had no previous convictions and had committed a minor crime, the court did not establish any circumstances that could mitigate or aggravate the punishment. In the end, he was sentenced to three years in prison.
The court's decision has not yet entered into force - the convicted person has the right to file an appeal.
